TOUR HOTEL DE LESPARRE MEDOC General Terms and Conditions of Sale
ARTICLE 1 – SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE
In the entirety of this document General Terms and Conditions of Sale, the words “CUSTOMER or CUSTOMERS” refer to the natural or legal person having made a reservation for the services provided by TOUR HOTEL.
These general terms and conditions of sale apply to all bookings made directly with the reception desk or by phone or on the website https://hotel-medoc.fr or partners websites, for example: Booking.com
Any reservation made directly with the reception desk or by phone or on the website https://hotel-medoc.fr or partner websites implies that the Customer has read and understood these general terms and conditions of sale and agrees to their entirety.
TOUR HOTEL reserves the right to adapt or modify these general terms and conditions of sale at any time. In this case, only the general terms and conditions of sale in force when the reservation was made shall apply.
TOUR HOTEL advises the Customer to save and/or print these general terms and conditions of sale for safe and durable storage, so that they can be invoked at any time during the performance of the contract if necessary.
In the entirety of these terms and conditions, the Customer shall be understood to be the party with whom the purchase-sale relationship is established and who will be invoiced for the reservation.
ARTICLE 2 – PRICES
2.1. All prices of the products offered for sale are expressed in Euros, all taxes included.
2.2. TOUR HOTEL reserves the right to modify its prices at any time but undertakes to apply the rates in force at the time client booked, subject to availability on that date. In the event of a change to the booking, the rates at the date of the change will be applied in place of the previous rates, including the replacement of special offers, promotions and exceptional discounts..
ARTICLE 3 – THE ORDER – ORDER VALIDATION
3.1. Reservations are made on the website https://hotel-medoc.fr , by phone or at the reception desk.
3.2. Contractual information is presented in French.
3.3. The Customer’s attention is particularly drawn to the method of acceptance of the order placed on the website https://hotel-medoc.fr. The “click” on the checkbox on the acknowledgement and acceptance of the general terms and conditions of sale, validating the order, and the “click” on the order button afterwards, are equivalent to an “electronic signature” and to a handwritten signature. They constitute an irrevocable and unconditional acceptance of the order by the Customer. Unless proven otherwise, the data recorded by the TOUR HOTEL on the Internet, by phone or at the reception desk constitute proof of all transactions between the hotel and its Customers.
3.4. Contractual information relating to the reservation, including the invoice number, will be confirmed by e-mail in due course. The TOUR HOTEL strongly advises the Customer to print and/or file this order confirmation on a reliable and durable medium as proof.
3.5. The information provided by the Client when making the reservation (in particular name, date, type of room, phone number, occupants quality and number) is binding. Thus, the TOUR HOTEL may not be held liable in the event that an error in making the reservation prevents or delays the availability of the room.
3.6. The TOUR HOTEL reserves the right to refuse any reservation from a Customer with whom there is or has been a dispute over payment of a previous reservation made with the TOUR HOTEL.
3.7. The Client declares that he/she has full legal capacity to commit himself/herself under these general conditions of sale.
ARTICLE 4 – AVAILABILITY
4.1. The room and price offers are valid as long as they are visible on the site, within the limit of available stocks.
4.2 In case of unavailability of a room for administrative or technical reasons after the order has been placed, the Client will be informed of the period within which the room will be available. The Client who does not wish to wait for this availability or in case of definitive unavailability of the room, will be reimbursed the amount of his reservation within the limit of the sum from which his bank account has been debited, and this within thirty days following the effective date of payment.
ARTICLE 5 – GUARANTEE OF PAYMENT AND PAYMENT
5.1 The Deposit and Payment Guarantee
The customer’s credit card information is kept for the duration of the stay and one month after the stay as a guarantee for the payment of all services and expenses incurred during the customer’s stay.
If the client does not have a bank card, a deposit cheque for a fixed amount of 500€ (five hundred Euros) will be required and kept for the entire duration of the stay and one month after the stay as a guarantee for the payment of all the services and expenses incurred during the clients’ stay.
Reservations are payable on the day of booking or check in .
Payment is made by :
Credit card with one of the following symbols: CB, Visa, Mastercard. The order will only be considered as accepted by the TOUR HOTEL MEDOC when the bank payment centres concerned have given their agreement and the TOUR HOTEL has validated the reservation in terms of its risk acceptance criteria.
By cash in Euros on arrival at the reception desk.
Cheques are not accepted for payment.
ARTICLE 6 – RESERVATION CANCELLATION
6.1 Individual reservations free cancellation:
For individual bookings of one room and out of high season July and August with a delay of 24 hours before the expected arrival date at noon is free.
For single room bookings in high season July and August with a deadline of 48 hours before the expected arrival date at noon is free of charge.
6.2 Group bookings free cancellation:
For group bookings of several rooms and out of high season July and August with a deadline of two weeks before the expected arrival date at noon the cancellation is free of charge.
For group bookings of one room in high season July and August with a deadline of three weeks before the expected arrival date at noon is free.
6.3 Cancellation with costs:
Outside the deadlines specified in articles 6.1 and 6.2, cancellation is subject to a charge
6.3.1 Cancellation with charges for individual reservations
For individual bookings of one room and outside the high season July and August, only the first night is charged (without tourist tax and without breakfast)
For single room bookings in high season July and August with late booking only the first two nights will be charged (without tourist tax and without breakfast)
6.3.2 Cancellation of group bookings with charges
For group bookings of several rooms and out of high season July and August with out of time cancellation the whole stay is due and charged (without tourist tax and without breakfast)
For group bookings of one room in high season July and August out of time, the whole stay is due and charged (without tourist tax and without breakfast)
ARTICLE 7 – ADDITIONAL COSTS
The client or occupant of the room must imperatively report any anomaly upon arrival in the establishment and in particular in the room made available to him.
Additional charges due to non-compliance with the rules and instructions for the use of the rooms and the accessories contained in the rooms may be invoiced and demanded for payment by the client(s) who gave the credit card information as a deposit.
Additional charges due to intentional or unintentional damage to the rooms and accessories contained in the rooms may be charged to and required to be paid by the guest(s) who provided the credit card information as security.
Towel or bath mat taken away by the client: a charge of 10 euros (including VAT) per item taken away will be made and demanded in payment.
Client having smoked in the room, at the window or at the open door of the room will be charged 60 Euros TTC for the treatment of the odours an invoice will be produced and demanded in payment.
Guests who bring an animal into the room: a fixed charge of 50 Euros (including VAT) will be made and demanded in payment.
Late check-out between 11.30 and 12.30 a.m.: a charge of €10 including VAT will be made.
Late departure between 12:30 and 1:00 pm: 30€ including VAT will be charged
Late departure after 1pm an additional night will be charged at the same rate as the previous night, except for discounts or special conditions.
The price list of accessories damaged or taken away by the client(s) must be requested from the TOUR HOTEL MEDOC reception desk. These prices may be revised and updated at any time by the hotel management.
Major damage will be invoiced upon presentation of the estimate(s) for repair. The client(s) may then claim on their liability insurance.
In the event of damage that prevents the rental of the room(s), an invoice for the amount of the rental of the room(s) for the entire period of unavailability will be produced and demanded in payment.
ARTICLE 8- RESPONSIBILITY
The photographs reproducing the products are not contractual. The Customer is requested to take note of the technical characteristics of the products before placing an order.
The liability of the TOUR HOTEL may not be sought in the event of an obvious error between the characteristics of the product, its illustration and its conditions of sale.
The total or partial impossibility of using the products due to incompatibility of equipment shall not give rise to any compensation whatsoever or reimbursement or to the liability of the TOUR HOTEL.
ARTICLE 9 – CUSTOMER SERVICE
For any question, information or claim, the TOUR HOTEL is available to the Customer:

ARTICLE 10 – APPLICABLE LAW AND DISPUTES
The present general conditions of sale and the online sales contract are subject to French law.
In the event of a dispute or claim, the Customer is advised to contact the TOUR HOTEL MEDOC.
In the absence of an amicable agreement between the Parties, the dispute shall be submitted to the competent court of BORDEAUX.
ARTICLE 11 – PERSONAL INFORMATION
All information collected by https://hotel-medoc.fr from the Customer is subject to computer processing for the purpose of processing the online order. It may be used for commercial prospecting and promotional communication relating exclusively to the activities of the TOUR HOTEL MEDOC, and may be transmitted to any administrative or judicial authority that so requests.
The occurrence of an unpaid bill due to fraudulent use of a bank card shall result in the recording of the details relating to your reservation associated with this unpaid bill in the management database of the establishment. An irregular declaration or an anomaly may also be subject to specific processing.
Right of access, rectification and opposition provided for in Article 4 above, and in accordance with the French Data Protection Act n°78-17 of 6 January 1978, the Customer may at any time access personal information concerning him/her and held by TOUR HOTEL MEDOC, and request its modification or deletion by post to the following address Tour Hôtel 14 rue des Rémouleurs 33340 Lesparre Médoc.
